Sustainable Law

Introduction

The world trade organization has always worked towards achieving sustainable development goals by 2030. Their main areas of concern are improvement of the health sector, reduce poverty, improve the education sector and protect the environment. The same goals were adopted in 2015 by United Nations and share the same vision by the world trade organization. In this case, the Republic of Valeria has seen the need to meet the growing demands of its citizens by engaging various members and non-member states in international trade for the mutual benefits of the both parties involved while also doing their best to conserve the general surroundings, preserving their indigenous species and protecting the human rights.  Campania which is its trading partner, however feel their trading agreements has been short-changed. As a special UN envoy, I came up with the following key findings which will form the basis of my conclusion and recommendation.
 
Key Findings

The Valerian government has shown commitment to sustainable environment as was depicted by being actively involved in the 2015 covenant made in Paris and has always supported the United Nations sustainable development goals. They even have a functional department charged with the mandate of addressing matters pertaining to environmental sustainability.
 
 
Additionally, they have set out strict measures to ensure zero emission of carbon by the sectors involved in the production process, this is in line with their growing concern over climate changes that is likely to endanger their indigenous species that form a large source of their revenue in the tourist sector.
 

The country is famously known for its sweet wine that is branded as Valerian Dessert Wines. The wine is unique in the country as it preserves their cultural heritage and practices. The production method is mainly tradition and is labour intensive. Campania, a developing country has heavily invested in the making desert wine made using the
 
Valeria Technique.

They have however mechanized their methods something that increased their production process at a lower cost and have been able to export their wines using the Valeria brand name at a half a price done by the original maker. The Valeria government however does feel that this technique used by this country is likely to pollute the environment hence they have imposed some rules and restriction on the Campanian people something that they have sharply disagreed with since they do believe the country has been exploiting developing countries, engaging in unsafe environmental practices something that violets the UN rules, it is corrupt and has equally violated human rights and endangered the lives of both plants and animals. In this regard I do find that they Valerian government has been engaging in the following unsafe practices;
 
 
The country has been exploiting Scorpios, a least developed country of its rare mineral which is mined without assessing its impact on the environment. Further, the mining process are being done by minors something that mounts to child labour. In addition to that, the transportation process via the Valeria waters has greatly endangered its water animals due to the spillage of this commodity on water and the department responsible for taking action against such measures has shown any signs of doing the same. For these reasons among others, I do believe their actions has violated various laws set out by various organization and bodies in regard to environmental conservation, international trade and preservation of human dignity. As a special UN envoy, I do feel the issues raised by the Campania needs to be addressed to find a lasting solution to their cause of dispute.
 

The central pillar of every multilateral trading system is settlement of dispute in an organized manner and the world trade organization has a peculiar way of contributing to the stability of world’s economy. The effectiveness of any rule-based system depends on the mechanism put place to settle disputes.  The procedures used by the world trade organizations emphasizes the rule of law hence ensuring the trading system is secure and anticipated. The organization is based on clearly defined rules and set out a timeframe for resolving cases. The main concern of the world’s trade organization is to settle this kind of disputes through a peaceful and consultative manner.
 

Campania should lodge the complaint with the world trade organization dispute resolution body to aid in finding amicable solution to their differences with the Republic of Valeria. The resolution will take a minimum of one year and a maximum of two years depending on whether there will be an appeal from any side. The dispute resolution process usually goes through various stages mainly;
 

In this case, the consultation and mediation process has failed to bare fruit hence it should seek the help of the director of world trade organization or any other body that can aid with the process. The organization will then form a panel to look at the matter raised by party involved in the case. The panel will then conduct a thorough investigation on the matters raised by the complaining country and then present its final report to the parties and the members of the WTO. In the event there is no appeal, the dispute settlement body will adopt the report.
 

The world trade organization has also set out labour standards that can be used to resolve the labour issues involved this case. This principle covers a wide ray of issues including both child and force labour. It is evidenced the country is exploiting its developing partner at the expense of achieving sustainable development goals by 2030. The mining is equally harmful and has deprived several people the right to life. All these go against the United Nations Commission on Human Rights provisions that advocate for the protection of human rights. Child labour is equally a criminal offence. In this regard I urge the complaining country to share the same concern with the both Scorpios and Valerian government to take action against the various departments charged with the responsibility of handling matters to do with human trade and trade and should the same persist, a formal complaint should be lodged with the international criminal court.
 

Sustainable development and protection and preservation of the environment remains major objectives of the WTO. Energy is a very essential commodity vital for the development process. In this regard, countries should use sources of energy that are environmentally friendly as they are less significant as long pollution of the climate is concerned.
 

These pollutants usually bring a lot of problems not only to animals but also human beings and plants. This has been evidenced by the surge in deadly and new diseases that never existed before human beings started engaging in activities that can be regarded as environmental unfriendly. Industrialization and urbanization have always been the major cause of negative climate change. Countries should be smart in their quest to achieve sustainable development goals to avoid jeopardizing the future generation. Proper planning that least pollute the environment should always be given top consideration while implementing development projects
 
 
Governments of every country should come up with strict measures aimed at conserving the environment. It is pointless to try to achieve the development goals at the expense of living and non-living things that form the basic parts of a country. For this reason, a country should preserve its beauty and take legal action against individuals or agencies that do engage in illegal, unsafe and unmonitored practices that violates human rights, exterminate indigenous species and have a direct negative impact on the future generation. No country should engage in practices that endanger the lives of its people or animals in the name of moving towards achieving sustainable goals.
 

With the country planning to go ahead with its smart city plan, it is likely to experience great change in its climate that is will tremendously affect its indigenous species and eliminate its precious tortoise that have been their major tourist attraction. The effects will range from global warming to Air Pollution to Water Pollution to Soil Pollution to Our Own Health and The Destruction of Wildlife.

While engaging in trade, developed countries should not take advantage of their economic status to exploit least developed countries but instead, should engage in trading activities that empower them. Additionally, environmental protection and protection of endangered species should always be the top agenda of every country in doing their day to day activities. They should further preserve human dignity and works towards achieving 2030 sustainable development goals.
 
Recommendations

From the above cases, I do hereby make the following recommendations;
 
 
1. The world trade organization should come up with strict measures to protect the least development countries from exploitation by developed countries.
 
 
2. The Republic of Valeria should disband and take legal actions against Valerian Environmental Sustainability Department for failing to protect its environment and allowing the country to engage in unsafe trading practices.
 
 
3. Various agencies responsible for the protection of children like the UNICEF should take legal action against Scorpios for engaging child labour.
 
 
4. The world trade organization should make strict such as banning of countries that engage in unsafe international trade from the market.
 
 
5. The Scorpios human right commission should take legal actions against the department involved in the mining of this commodity being exported.
 
 
6. In their quest to achieve sustainable development goals, countries should always but ethical consideration in place.
 
 
7. The dispute resolution methods involved in the multilateral trade, just be just, fair and fast.
